Is it legal for an AI agent to send texts in New Zealand?
Yes, within the Unsolicited Electronic Messages Act 2007. The Act bans unsolicited commercial electronic messages with a New Zealand link (s 9), and it covers texts as well as email. Messages that confirm a transaction the person agreed to, give factual account information or provide a quote they asked for are not commercial electronic messages (s 6(b)). What counts as a commercial electronic message?
Under s 6 of the Act, it's a message that markets or promotes goods, services, land or a business or investment opportunity, or links to one that does. The Department of Internal Affairs says a single message can count as spam.
What consent does the Act require?
Consent can be express (the person said yes), inferred from your relationship and conduct, or deemed when a business address is published conspicuously and the message relates to that person's role (s 4). The sender has to prove consent (s 9(3)).
What must a commercial text include?
It must clearly identify who authorised it and how to contact them (s 10), and include a free, working unsubscribe that works by replying the same way (s 11). An unsubscribe takes effect 5 working days after it's used (s 9(2)).
Who enforces the anti-spam law and what are the penalties?
The Department of Internal Affairs enforces the Act. Courts can order pecuniary penalties of up to $200,000 for an individual and $500,000 for an organisation (s 45). You can report spam texts free by forwarding them to 7726.
Can Agentline NZ be used to send marketing texts?
No. Marketing, promotions, cold texts and bulk texts are blocked. Transactional and assistant messages only: replies, bookings, confirmations, reminders people asked for, and codes. See What we don't allow.
What is an 028 number?
It's part of New Zealand's 02x mobile number range. The 028 range is split into small blocks held by many carriers and service providers rather than one network. How do I write an 028 number in international format?
Drop the leading 0 and add +64, so 028 X XXX XXXX becomes +64 28 X XXX XXXX.
Can my assistant text landlines or overseas numbers?
No. Standard NZ mobile numbers only (020–029). No landlines, short codes, premium or international numbers.
